Duration: 90 Minutes
Description:
This webinar will offer estate planners a comprehensive analysis of the rules, opportunities, and challenges associated with using IRS Section 1031 like-kind exchanges and Delaware Statutory Trusts (DST) in estate planning. Our panel will provide insights into IRS federal rules and regulations, highlighting crucial areas to meet the requirements for 1031 exchanges. We will also discuss how to structure DSTs for specific estate planning transactions, address tax basis considerations, and cover other important aspects to maximize tax savings.
A 1031 exchange or a Delaware Statutory Trust (DST) can be powerful tools in estate planning when structured correctly. Taxpayers and their heirs can reap significant benefits when properties are exchanged for like-kind assets through a 1031 exchange, while DSTs can potentially allow for the deferral of capital gains for decades.
Section 1031 of the U.S. Tax Code enables investment property owners to defer capital gains taxes and depreciation recapture by exchanging a relinquished asset for a “like-kind” replacement asset. This means that by reinvesting the entire sales proceeds into a new asset, you can “buy up”—acquiring a replacement asset of greater value or quality. This webinar will explore the structuring process and essential estate planning considerations associated with like-kind exchanges.
